Terms of Service

These terms cover use of this website and reservations, payments, promotions, and visits connected with Top Shelf Golf.

EffectiveOctober 9, 2026

Please read these Terms of Service (the “Terms”) before using topshelfgolfap.com or making a reservation. By using the website, submitting a request, or completing a booking, you agree to these Terms. If you make a reservation for a group, you are responsible for sharing the rules that apply to the visit with your guests.

Who manages what

One experience, clear responsibilities.

Top Shelf Golf

Operates the venue and is responsible for reservations, payments, refunds, golf bays, events, food and beverage service, guest safety, and all other on-site services.

Project HGM

Hosts, maintains, and technically manages this website. Project HGM is not the venue operator, merchant, payment processor, food or alcohol provider, or provider of the booked experience.

01

Using the site

You may use this website only for lawful, personal purposes, including reviewing venue information, contacting the team, and making or managing a reservation. You must provide accurate and current information. You or anyone on your behalf shall not do any of the following: interfere with the website, attempt unauthorized access, introduce harmful code, scrape content through automated means, impersonate another person, or use the site to commit fraud or violate another individual’s rights, or other unlawful purpose not explicitly stated.

If you use the site or make a reservation for a business or organization, you represent that you are authorized to act for it. A parent or legal guardian should supervise a minor’s use of the site and any booking made for a minor.

02

Reservations and availability

Dates, bays, start times, session lengths, player limits, and prices are subject to availability and the information shown when you book. A selected time is not guaranteed until the booking flow confirms the reservation and the full session payment has been successfully completed.

Top Shelf Golf may contact you to correct an obvious scheduling, pricing, or availability error. When reasonably necessary, Top Shelf Golf may move, shorten, cancel, or decline a reservation because of equipment problems, maintenance, safety concerns, severe weather, an event conflict, or another circumstance beyond reasonable control. If Top Shelf Golf cancels a paid reservation, it will determine the appropriate rescheduling or refund option under the policy communicated for that booking and applicable law.

Top Shelf Golf shall not be responsible for delays, closures, cancellations, or inability to provide services resulting from acts of God, severe weather, utility failures, internet outages, governmental actions, labor disputes, public health emergencies, equipment failures, supplier shortages, fires, floods, or other events beyond its reasonable control.

Cancellation, rescheduling, no-show, credit, and refund rules are the rules shown during checkout or included in your booking confirmation. If no specific rule is displayed, contact Top Shelf Golf before changing your plans. These Terms do not create a separate promise that a payment is refundable.

03

Full session payment

Bay sessions cost $40 per bay per hour, before applicable tax. The full session price is paid through Square when an online reservation is confirmed. The booking summary shows the session price, any promotion, applicable tax, and total before payment. Gratuities, food, beverages, add-ons, and other purchases are separate unless explicitly included.

If online payments are enabled, payment information is handled by Square or another identified payment provider. That provider’s own terms and privacy practices also apply to its services. Top Shelf Golf is the merchant for venue purchases; Project HGM does not receive, hold, or refund customer payments. You authorize the displayed charge when you submit payment and agree not to use a payment method without permission.

04

Safe play, guest conduct, food, and alcohol

Guests must follow posted rules and staff instructions, use simulator and golf equipment responsibly, remain within designated hitting areas, and avoid swings when another person is within range. Top Shelf Golf has the right to stop play or remove a guest whose conduct is unsafe, disruptive, unlawful, or damaging. The person making the reservation agrees to be financially responsible for damage to venue property, simulator equipment, furnishings, fixtures, or rental equipment caused by the intentional misconduct, reckless conduct, or negligent misuse of the reservation holder or members of the reservation holder's group, to the extent permitted by Michigan law.

ASSUMPTION OF RISK. TO THE FULLEST EXTENT PERMITTED BY MICHIGAN LAW, EACH GUEST VOLUNTARILY ASSUMES ALL ORDINARY AND INHERENT RISKS ASSOCIATED WITH GOLF, GOLF SIMULATORS, SWINGING CLUBS, GOLF BALLS, SLIPS, TRIPS, FALLS, CONTACT WITH OTHER PARTICIPANTS, AND THE USE OF THE PREMISES, EQUIPMENT, FOOD SERVICE AREAS, PARKING AREAS, AND COMMON AREAS. EACH GUEST ACCEPTS PERSONAL RESPONSIBILITY FOR PARTICIPATION AND FOR TAKING REASONABLE PRECAUTIONS TO AVOID INJURY.

TO THE FULLEST EXTENT PERMITTED BY LAW, TOP SHELF GOLF IS NOT RESPONSIBLE FOR INJURIES RESULTING FROM A GUEST'S FAILURE TO FOLLOW POSTED RULES, STAFF INSTRUCTIONS, SAFETY WARNINGS, OR REASONABLE OPERATING PROCEDURES.

Golf and simulator use involve movement, swinging equipment, balls, raised surfaces, and other ordinary recreational risks. Participate within your abilities, use reasonable care, and tell staff promptly about unsafe conditions, injuries, or damaged equipment.

In the event of a medical emergency, Top Shelf Golf may contact emergency responders or obtain medical assistance on behalf of a guest if circumstances reasonably require it. Top Shelf Golf assumes no responsibility for the cost, quality, timing, or outcome of any medical services rendered.

Alcohol may be purchased and consumed only by guests who are at least 21 years old and can present valid identification. Top Shelf Golf may refuse or stop alcohol service when required by law or when staff believes service would be unsafe or inappropriate. Guests may not bring outside alcohol.

Top Shelf Golf reserves the right to refuse entry, service, participation, or continued occupancy to any person appearing intoxicated, impaired, disruptive, or unsafe. Guests agree to arrange lawful transportation and not operate a motor vehicle while impaired.

Menu descriptions may change and do not guarantee that an item is free from an allergen or cross-contact. Tell venue staff about allergies or dietary concerns before ordering. Raw or undercooked foods may carry additional risk; review the consumer advisory on the menu and ask staff if you have questions.

05

Prices, promotions, and promo codes

Prices and availability may change before a reservation is confirmed. Promotions may have stated start dates, expiration dates, usage limits, eligible services, or other restrictions. Unless a promotion says otherwise, it cannot be combined with another offer, exchanged for cash, or applied to a completed purchase. Top Shelf Golf may reject a code that is expired, ineligible, altered, duplicated, or used in violation of its stated terms.

06

Random browser identifiers expire after 30 days; traffic events are retained for up to 90 reporting days. Analytics do not include names, contact details, payment information, IP addresses, or URL query strings. We respect browser Do Not Track and Global Privacy Control settings.

The Top Shelf Golf name, branding, photographs, menu content, graphics, and other site materials belong to Top Shelf Golf or their respective owners and may not be copied, sold, republished, or commercially exploited without written permission. If you submit a contact form, booking request, review, photo, suggestion, or other material, you confirm that you have the right to provide it. You permit Top Shelf Golf and Project HGM to use the submitted information as reasonably necessary to respond, operate the website, fulfill the request, protect the service, and maintain appropriate business records.

Security cameras and event photography may be used at the venue for safety, security, operational, promotional, and training purposes. By entering the venue, guests consent to being recorded in common areas, except where prohibited by law.

This website may link to Square, map providers, social networks, or other third-party services. Those services are independently operated and governed by their own terms. Neither Top Shelf Golf nor Project HGM controls or guarantees third-party availability, content, or practices.

07

Disclaimers and limits of liability

The website is provided on an “as available” basis. Top Shelf Golf and Project HGM do not promise that the website will always be uninterrupted, error-free, or compatible with every device. Website information may contain mistakes or become outdated, and venue staff should be contacted when a detail is important to your visit.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANY LIABILITY OF TOP SHELF GOLF ARISING OUT OF OR RELATING TO A RESERVATION, VISIT, OR USE OF THE WEBSITE SHALL NOT EXCEED THE AMOUNT PAID BY THE CUSTOMER FOR THE SPECIFIC RESERVATION GIVING RISE TO THE CLAIM.

To the fullest extent permitted by law, Top Shelf Golf and Project HGM will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the website. Project HGM is not liable for claims arising from venue operations, reservations, food or alcohol, customer payments, injuries at the venue, or services delivered by Top Shelf Golf or another provider. Nothing in these Terms excludes liability that cannot lawfully be limited, including liability for gross negligence or willful misconduct where applicable.

You agree to defend, indemnify, and hold harmless Top Shelf Golf, Project HGM, their owners, officers, managers, employees, contractors, agents, and affiliates from and against claims, liabilities, damages, judgments, costs, and reasonable attorney fees arising from: (a) your violation of these Terms; (b) your unlawful conduct; (c) damage caused by you or your guests; (d) injury caused by your negligent, reckless, or intentional conduct; or (e) your misuse of venue equipment or facilities, except to the extent caused by the gross negligence or willful misconduct of the indemnified party.

RELEASE. TO THE FULLEST EXTENT PERMITTED BY MICHIGAN LAW, EACH GUEST RELEASES TOP SHELF GOLF, PROJECT HGM, AND THEIR RESPECTIVE OWNERS, MEMBERS, EMPLOYEES, AGENTS, AND AFFILIATES FROM CLAIMS ARISING OUT OF ORDINARY NEGLIGENCE RELATED TO THE USE OF THE WEBSITE, PARTICIPATION IN RECREATIONAL ACTIVITIES, OR USE OF GOLF SIMULATORS AND RELATED EQUIPMENT. THIS RELEASE DOES NOT APPLY TO CLAIMS ARISING FROM GROSS NEGLIGENCE, RECKLESSNESS, OR WILLFUL OR WANTON MISCONDUCT.

You agree to be responsible for losses and claims caused by your unlawful use of the website, your material breach of these Terms, or your intentional misuse of venue equipment, subject to applicable law.

08

Changes, governing law, and general terms

The website, its features, and these Terms may be updated from time to time. The effective date at the top of this page identifies the current version. Changes apply when posted, unless a different date is explicitly stated.

Michigan law governs these Terms, without regard to conflict-of-law rules. Any court proceeding relating to these Terms or the website must be brought in a court with jurisdiction in Wayne County, Michigan, unless applicable law requires another location. If part of these Terms is unenforceable, the rest remains in effect. A failure to enforce a provision is not a waiver of it. These Terms, together with any terms shown during checkout or in a confirmed reservation, form the agreement concerning the website and that reservation.
